These Terms and Conditions (“Terms”) govern your access to and use of viralGee, including all generators, pages, tools, and related services (“Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Use of the Service

You may use viralGee for lawful personal or business purposes. You are responsible for all content you create using the Service and for how you use, distribute, or publish that content. Use of the Service implies acceptance of these Terms in full.

2. Acceptable Use

You agree not to use viralGee to:

Violate any applicable law or regulation.
Impersonate real individuals or entities to commit fraud, harassment, or deception.
Create or distribute defamatory, abusive, harassing, threatening, or harmful material.
Infringe the intellectual property, privacy, or other rights of any person or entity.
Produce content that sexualizes minors, depicts non-consensual acts, or constitutes illegal content under applicable law.
Attempt to disrupt, overload, damage, gain unauthorized access to, or reverse-engineer any part of the platform or its infrastructure.
Use automated tools (bots, scrapers, scripts) to access or abuse the Service at scale.

We reserve the right to determine, in our sole discretion, whether use of the Service violates these Terms and to act accordingly, including immediate termination.

3. Generated Content, Server-Side Logging, and Responsibility

viralGee’s generator tools create visual content based on inputs you provide. You retain full responsibility for the content you create and any downstream distribution or publication. viralGee does not pre-screen or approve user-generated outputs.

Server-side session logging: When you use a generator tool, viralGee may capture and store server-side snapshots of your session, including the inputs you have entered (such as text fields and settings) and rendered images of your output. This is done for operational purposes including debugging, quality assurance, and customer support. By using the generator tools, you acknowledge and consent to this data capture as described in our Privacy Policy.

viralGee staff may access stored session data and images for the purposes described in our Privacy Policy. We may also review stored content where necessary to investigate abuse, enforce these Terms, or comply with legal obligations.

Content you enter into the generators should not include sensitive personal data (such as real private information about third parties) beyond what is necessary for your intended creative use. You are responsible for ensuring your use of the Service does not violate the privacy or rights of others.

4. Intellectual Property

The viralGee brand, website design, software, and original assets are protected by applicable intellectual property laws and remain the property of viralGee. You may not reproduce, distribute, or create derivative works from our proprietary materials without written permission.

Third-party brand names, logos, and trademarks displayed within generator templates or examples remain the property of their respective owners. viralGee does not claim ownership of third-party marks and their use within the platform is purely for simulation and creative purposes.

You retain ownership of any original content you create using the generators. By using the Service, you grant viralGee a limited, non-exclusive license to store and process your content as necessary to deliver the Service and as described in our Privacy Policy.

5. Pricing and Payments

Some features are available for free and others require a paid subscription. If you purchase a plan, you agree to the pricing and billing terms presented at the time of checkout. Payments are processed by Stripe. We reserve the right to change pricing with reasonable advance notice. Refunds are subject to our refund policy in effect at the time of purchase.

6. Availability and Changes

We may update, modify, suspend, or discontinue any part of the Service at any time to improve reliability, security, or product quality. We are not liable for any interruption, modification, or discontinuation of the Service.

7. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by applicable law, viralGee and its operators, affiliates, and employees are not liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to viralGee in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless viralGee and its operators, affiliates, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) content you create, share, or distribute using the Service; or (c) your violation of these Terms or applicable law.

10. Termination

We may restrict, suspend, or terminate your access to the Service at any time, with or without notice, if you violate these Terms, abuse the platform, engage in fraudulent activity, or create security or legal risk. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including limitation of liability, indemnification, and intellectual property) will continue to apply.

11. Governing Terms and Dispute Resolution

These Terms are governed by and interpreted under applicable law. If any provision is found to be unenforceable, that provision will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in full force and effect. Any dispute arising from these Terms or your use of the Service should first be raised with us by contacting info@viralgee.com so we can attempt to resolve it informally.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected with a revised “Last updated” date on this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.
